Has any one ever heard of 140 denial due to less percentage of marks secured in graduation.
Job desc is the key, Hope you are talking about a hypothetical scenario. if you are talking about a real scenario you need to take a look at job requirements and desc. If the case is a substituition case then proof of burden is on employer. I think if we are talking about a real scenario then one should get an RFE before a denial.

My friend had applied for GC through B (never worked, PD-2004/EB2, 140 approved and 485 more than 6 months) and he was continuing with company A on H1B.
Company A was laying him off. He tried to go to company B. But Company B was getting folded.
He went out and got a better offer from company C. He had two choice. Apply H1B transfer from A to C or use AC21.
He chose to use AC21 and started with C. Lawyer explained the situation with AC21 info to USCIS.
Now the best part. HE GOT GC last month.
Company A was laying him off. He tried to go to company B. But Company B was getting folded.
He went out and got a better offer from company C. He had two choice. Apply H1B transfer from A to C or use AC21.
He chose to use AC21 and started with C. Lawyer explained the situation with AC21 info to USCIS.
Now the best part. HE GOT GC last month.

As you know if you can find another job based on H1 then no problem in porting your H1 to a new employer,now being in feb april is 50 days away so hope for best.
In this situation, yes, legal advice is preferred, relying info on the forums is never a right idea when it comes to a situation where stakes are high.
If there is any option of changing to H4 now and switching back to H1 later and pick the GC process where it was left before then that would be an ideal scenario, only an experienced attorney can answer this, hence the legal advice option.
Compared to H4, over stay may cause more trouble for now and later in AOS.
PS: My 2 cents and i'm not an attorney.

I heard TCS is calling back many of their TL/PL/PM back to India. I heard it from 2-3 differrnt sources. Just wanted to see if anybody knows about it.
I personally know a person who is with TCS, he is a team lead or something.... asked to go back by TCS..... they are returning in mid Feb.....

How important is filing date when it comes to I-485 processing? Does USCIS process I-485s by Filing Date or by Priority Date? If it does so by Filing Date, and assuming that the dates stay current for a long time, does it mean that a person with a later PD can get his/her I-485 processed before a person with an earlier PD if the person with the earlier PD has a later FD?

I am planning to visit India during May 2011. I am working in multinational company as civil engineer (on H1-B). I have PhD from US uni. I am reading a lot about visa stamping probs these days. Many times you get 10 year visa that does not mean they can stay for 10 years. You never get to stay more than 6 months and under exceptional circumstances that is increased to a year.

Ok.. to answer your question: Your parents _must_ start within 2 months from the time 2-month Visa issued. In other words, your parents must travel before the expiry of Visa in the passport.
Once they come here, how long can they stay _legally_ in USA depends on I-94 card. Typically I-94 card will be given with an expiry date, which I belive will not be _beyond_ expiry date of the Visa in the passport.

company A wants to sponsor my h1. I have physical therapist license from STATE A and Letter from State B that they do not issue license without ssn no ( and i have letter from credentialing body also saying i meet all requirements for licensure for STATE B,I also have visa screen and other required documents.
can company A file An H1 with multiple LCAS - 2 states, so H1 is issued for 3 years
What service centre would the application go to-the one for which i have license of the one for which i have letter from board (ssn needed for license).
Once the h1 is approved can i work in any of the 2 states.
How long is the H1b taking to get approved if filed in regular processing and say no rfe is recieved
What problems could the approval face

I have applied my labor in EB3 category. As i am qualified for the senior position i have asked my management for the next level. so that i can apply in EB2 and get the priority data transferred from EB3 application.
with the July fiasco applied I485 with the EB3 application. Now my management is working to promote me from software dev to Sr software developer. Should i accept the promotion? my job responsibilites will be same with additional responsibilities. What will happen to my i-485 application if i take the promotion?

hello all,
i filed my application on july 2nd to nebraska service center. Now i am filing my wife' application using the new updated 485 form. i sent my application to nebraska service center. i live in florida and in the new form i have noticed that they are asking people from florida to send 485 application to texas service center.
i am confused as to where i should send my application. i am attaching a sheet which asks mailroom to attach my wife's new application to already filed my application ( sent on 2nd july with no recepit ).. i am just confused that if i send my application to texas will it get attached to my primary already filed application... any one in same situation or any insite please help.
