I think your employer should cooperate with you by not withdrawing your I-140.

I got tired of searching for appointments myself on the NVARS website and signed up with XVARS instead. Lets see if they deliver. I picked Toronto between 12/07 and 12/20 so hoping they find me my appointment. Will post an update again soon.

yes, in general as per law, you have to file tax returns to both states.
But most of the desi-employers try to use same state that they used first part of year and continue with that till end of year. But in the next year, they start with new state. This happens all the time with most of the desi-employers. There is no problem. You are not skipping any taxes, it is your employer's responsibility. If your employer says, he is working here and paying state taxes, then thats it, nobody can't say/argue anything.

But now looking at my W2 it shows that my employer has been filing taxes in my previous state Missouri for the entire year. How should I go about correcting this? I was in Missouri for 5 months and in South Carolina for the remainder. In which state should I file my tax too?

This is my understanding PERM has no fees to department of labour. Is that right ?
Can employee may attorney fees for PERM ?

One more clarification, once petition is converted to F1 and I get married after that what will happen to the petition. will it stay in F1 cateogory or converted to some other category or it will be revoked and I will have to do fresh start.

I want to transfer from H1B to F1.I came to US as a F1 and graduated in march 08.I got my H1B on oct 08.But now i want to transfer to F1 again and i had my visa till 2011. I had following doubts and please help me.
1) I heard that i can transfer to F1 from H1B without canceling(but deactivating H1B) is it true.
2) How much time does it take if i apply for change of status for F1?

My wife changed her status from B2 to H1 in US.Her H1 was approved without any problems.Could that cause any probelms in the future when she applies for green card.What is the chance to get her H1 denied in the consulate if she travels abroad because she changed from visitor to work visa in US?

If the gap between arriving on B2 and converting to H1B was less than 3 months, there could be a problem with "intent" as H1 is considered a dual intent (temporary non-immigrant worker who may have the intention of applying for a permanent immigrant visa i.e., GC) visa while B2 is not. While filling up the B2 application, there is a question which we need to answer NO asking this very question. I assume your wife answered NO during the B2 process. So, with H1 in less than 3 months (if this is the case) or arrival, she has "lied" in her B2 application as per the immigration laws.
I may be wrong.Please consult an attorney if needed.

Hi,
My employer has initiated my H1 B visa for our client which is a telecom giant. I was denied H1B with the reason that I am a Mechanical Engineer. The document says that as a mechanical engineer I need 6yrs exp. I already have more than 4yrs exp in IT. The thing which wonders me is that, 2 of my engineering classmates got their H1 approved. Is there any clause which says about this. Please help me.

I am about to file the 485/EAD/AP based on EB2 PD May 2003.
My lawyer says that after July 30th 2007, if we are filing EAD & AP along with 485, then we do NOT need to include the fees of EAD and AP. The total fee in such a case is 1010$.(485 + Biometric = 930+80 = 1010$)
Is this correct that if EAD/AP are applied with 485 after July 30th 2007, then there is no special fee for EAD/AP

This long wait for Green Card has made me think about a number of things...
A few days back a couple of my friends have recieved notices from USCIS are sending notices 'Intent to Deny their I-485' w/o any rhyme or reason. Employer says they have not withdrawn their I-140. They said they will appeal but if nothing happens they will go back to India.
Just worried...if this happens to me and I am forced to go out of the country in 30 days, what happens to my US loans. I do not think I would be able to repay back my home & car loans with an Indian salary if I return. In this market I can only sell at a huge loss. I also used US Line of credit for education purposes. Do I need to file bankruptcy? I am on a EAD right now...
Any thoughts on this... greatly appreciate ....it

1. 485 received date Aug/1/2007, notice date Sep/27/2007 - for all three of us.
2. We applied for a change of address in May/2009 and received acknowledgement from USCIS in June/2009 - for all three of us.
3. My son's RFE response acknowledgement dated July/2009.
Please help me to figure out LUD for our applications.
