My wife is scheduled to appear for fingerprinting at 1 om a future scheduled date. However I learned from someone that she can go for the fingerprinting even earlier in the day and she will be fine. Is this true? Has anyone experienced this?
I have tried this when i went for my finger printing for my EAD. My interview was in afternoon and went around 8:30am and they did allow me.

This area is fast moving. Indian courts have been refusing jurisdiction in these cases, unless one of the parties is an Indian resident or if they spent significant time in India after marriage. Best to consult an Indian lawyer to find out the current standards applied in India.

The Swine Flu saga continues. Mexico reported three new deaths from the swine flu epidemic Saturday and urged citizens not to let their guard down against a virus that has killed 19 in people in Mexico and is spreading across Asia and Europe.
Health Secretary Jose Angel Cordova said Mexico's confirmed swine flu cases jumped to 473, including the 19 deaths. The previous death toll in Mexico was 16. A Mexican toddler also died in Texas days ago, for a worldwide total of 20.
In accordance with measures announced by the Government of Mexico to limit the congregation of large crowds to prevent the spread of the H1N1 virus, the U.S. Embassy in Mexico City and the U.S. Consulate General in Ciudad Juarez advise that most consular services are being suspended. The dates listed below may change. The Embassy and Consulate General will monitor the H1N1 situation continuously during the week and will update information on our website if the dates of the suspension of service change.
Immigrant Visa operations in Ciudad Juarez have been suspended from April 30 to May 8. Immigrant visa and waiver applicants who have April 29 appointments should proceed to the Consulate. The panel physicians are closed. Those applicants who have consular immigrant visa appointments after May 8 and have not yet obtained their medical exams should not come to Juarez until the panel physicians have re-opened.
All non-immigrant visas operations in Mexico have been suspended until May 6.
Consular services for U.S. citizens throughout Mexico will be limited to emergency assistance and to citizenship applications (passports and consular reports of birth abroad, or CRBA). Anyone with passport or CRBA appointments are encouraged but not required to reschedule to a later date. Getting name change while you are on Indian passport is a lot cheaper and easier than getting it done on US passport.
You get the name changed in Indian passport. Then you need to get a new I797. USCIS notifies SSA, who will issue you a new SSN card (you cannot get ssn changed directly).
I am not sure how much of this is an issue with GC process.

Hi guys, I have a unique situation, thanks to july visa bulletin. I have a EB3 labor and I 140 approved with the PD as May 2004. Recently I applied EB2 PERM in order to port the PD from EB3 to EB2. My EB2 perm is approved now. Now, I am in dilemma to choose between EB2 and EB3. I can apply EB2 I 140 and I 485 concurrently (by assuming that they will port the PD) or I can apply I485 (for previously approved EB3). Please suggest as to what route I should take.

I am a Spanish citizen and I am currently holding an F-1 visa with post-completion OPT that expires in 06/2011. I am working at a company in VA and I got married in Michigan to a US citizen in 09/2010.
My company is offering to sponsor me for an H1B visa in order to continue working here after 06/2011. I am also preparing all the paperwork to apply for a change of status to a green card through marriage (I-130/I-485). Can I submit the green card application at the same time as my company submits the H1B request?
Yes. They are independent.
I also have to travel outside the US on 05.2011. I know I would have to ask for advance parole in case of green card application or obtain an H1B visa stamp outside the US if the H1 has been processed.
You must have advance parole to travel abroad after you have applied for green card. If the green card is approved while you are abroad and you do not have AP, theoretically the green card is considered abandoned.
H1-B VISA is independent of green card. You can obtain an H1-B VISA in a consulate abroad after you have the I-797 (H1-B approval).
What is the best way to be able to travel abroad in these circumstances?

You can get -

2. New/Extend H-1B for 3 year, but will be subject to cap
3. can get new/extension H-1B for 3 years without cap, if you have I-140 approved
4. can get new/extension H-1B for 1 year without cap, if I-140 is pending

The reason I was asking is because recently this application to consider this as a new H1b for 3 years was rejected and instead only one year (recapture time for year abroad) was issued.

It is doubtful that anything other than amnesty would kill this legislation.
There is a serious risk for the Democrats in forcing their members to vote
down an amnesty bill. That would undoubtedly alienate one of their core
voter constituencies.
If the SAVE bill passes, the likely result is that support for legal immigration reform will increase substantially. A number of members of Congress have said that they support legal immigration reform, but first want to see new enforcement measures put into place"

Last week friday my advance parole document from NSC was approved & sent , but we have not received the approved document yet.

In general, macro lenses around 100mm are good for most kinds of macro photography. They have too much working distance for use on a copy stand, and not quite enough for skittish and/or dangerous insects or small animals. For general purpose stuff, the angle of view is such that you get enough background isolation to be worthwhile (you can rotate around your subject just a bit to get a highlight out of the background, while a 50mm macro takes in more background and makes this difficult).
I got a used Tamron 90mm, and let's just say that the build quality does not inspire confidence - however, the image quality is excellent. From what little I've seen of the Sigma 105mm macro (and from the many images that the members here have posted), it appears to have a bit better build quality and fine image quality as well. The Nikon macro is not going to be much better, if at all, in image quality than these, and you will pay dearly for the brand name. The one macro lens to avoid, however, is a "Phoenix" macro that only goes to 1:2 (that means that you can't get enough magnification for most small insects and flowers to fill the frame) and is most likely more cheaply built than my Tamron. Almost every other macro lens goes to 1:1 these days, and you can get the nicer ones used from KEH for not much more, so there's no reason to buy not-so-ideal lenses that you'll outgrow in no time anyway.
