I do have house here and I am 6th year of H1B, I did appeal on my I-140. If that gets denied I have no option than going back. In that case I have to sell my house or file bankruptcy foreclosure +++.

I just wanted to share some good news. I had two approved LCs. One with PD EB3 ROW March 05 and the other with ROW EB3 March 06. I had already filed the I-140 for the March 06 but not for the March 05 one. That was because of the way the job requirement was worded in that LC. The attorney was not sure if it would be approved. Anyway since the earlier PD became current in June I decided to take a chance and file I-140 for that earlier PD LC with PP. And what do you know, it got approved today and that allowes me to file for AOS this month. It was a bit of a gamble with money but it worked!!! :cool:

Friends,
I got LC and 140 approved in EB3. Now I refile my labor Cert in EB2 (IT manager) via PERM. Anybody has the same experience and know approximately processing time for this PERM to be approved. Thanks for any information.

I have recently received an RFE on my I-485 application asking me to provide receipt number or A number for my spouse and child as I have included them in my application. I don't know how to respond to this and need your help to provide a suitable response.
I didn�t submit I-485 application for my spouse and child as they were out of the country while i filed my mine. My family continues to live outside US while I'm here working on H1 and also have my approved labor (Feb24 2007) EAD (Nov11 2007) and I-140(Feb10 2009)
Question is how to respond to RFE as I can't provide A number or receipt number. Also as my spouse and child are born in a country where they still have visa numbers available, can I claim cross chargeability to my spouse country of birth as the visa numbers are not yet available for India for my Priority date.
As I have my chances of speedy processing with cross chargeability, how should I respond to RFE without I-485 filed for my family? Is it possible to ask for consular processing for my family with an intend FTJ? Please help me to answer in a way that would help my processing faster.

I'm currently working in Company A, My first 3 years visa is going to get expire on SEP-2009.
My current company has some issues, so If I apply my extension through my company I won't get my extension for sure.
So I contacted Company B , and applied for my H1 Transfer, they filed my H1 Transfer on 04/10/2009 through normal processing. I would like to know whether I need to switch from Normal processing to Premium Processing. If yes, then what's the procedure. I really appreciate all your time and efforts in answering my questions.

Once you take appointment you can call the same consulate and sned required documents and get PIMS verified.

Like I said earlier, you have 240 days before you go out of status. If you are receiving an RFE, it means your case is under review. Upon receiving your response to the RFE, the officer should be able to adjudicate case fairly soon. However, if you are nervous, I recommend file for an expedited review when sending your response. That said, I would hate to pay the extra $$$$ if I don't have to.

We have the same notice date - 10/11 but my receipt date is 7/03. And I got my EAD on 10/26. They may be starting a system to process EAD/AP by receipt date. But still...who knows what they are doing it.

Our cases at at TSC presently. I asked him to sent it to TSC but he said since the original EAD / AP were approved by VSC the renewal has to also go to VSC.
I am not sure what is going to happen. I have not seen my cheques cashed nor have received the package back?
FedEx trackinh number says it was received at VSC on July 10.
Can anybody shed some light whats going to happen next ?????

I asked exactly the same question a few days ago and ppl replied that h1B is totally different case. H1B does not get affected irrespective of whethe it came thorugh due to 140 already approved or LC approved or a < 6 years limit.

I have received so many different responses regarding the shots required for over 65s. Our local health department, the INS Doctor and the INS all seem to be providing different information, I'm hoping someone can clarify.
The civil surgeon provided us with a list of shots, basically it contained all the shots including those that I thought were just for children. We went to a public health nurse today who gave us TDP and Varicella shots. Are the MMR, flu and pneumococcal shots required by the INS?
The INS approved Doctor wanted $600 per person for all of the shots. The exam and blood test were $120. We've decided to go to a private Doctor and the local health department for the shots instead of paying the $600. I'm hoping someone can clarify what is needed so that we avoid paying for shots that are not needed.

I got an RFE in Oct 2008 and responded to it. I a, hoping that I'm not going to get another RFE and also hoping that my application is pre-adjudicated and once the visa numbers are available (within one to ten years?!), i'll get the GC.

1. First question in the ITIN form w-7 is: Reason you are submitting Form W-7. (there are couple of options)
Is the option in my case: "Spouse of U.S. citizen/resident alien"? (and it asks for the resident's i.e. my name and SSN.)
What are the other options
2. Item 6d. "Identification documents submitted" ?
Options are for passport, Divers License, USCIS documentation.
My wife has all the three. Her H4 visa is stamped and valid. What all should I submit?
Notorized copy of the passport which shows the valid visa...
